NAINITAL, India, Feb. 16 -- Uttarakhand High Court issued the following judgment/order on Jan. 15:
1. Mr. Vinay Bhatt, learned counsel for the Applicant.
2. Mr. B.C. Joshi, learned AGA, for the State of Uttarakhand.
3. In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 480 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant - Saarim Hussain @ Saalim Hussain, who has been accused in FIR No.417 of 2025, under Sections 121 (1), 132, 190, 191 (2), 191 (3), 221, 324(3), 351 (2), 352, 109, 196 (1) (c) of BNS read with Section 7 of the Criminal Law Amendment Act and Section 3 of the Prevention of Damage to Public Property Act, at Police Station Kashipur, District Udham Singh Nagar. The Applicant is in judicial custody since 25.09.2025.
4. At the outset, learned counsel for the Applicant submits that the co-accused in BA 1st No.74 of 2026 has been granted bail by this Court vide judgment and order dated 14.01.2026.
5. Considering the overall facts and circumstances of the case and the fact that the co-accused has been granted bail by this Court, the Applicant has made out a case for bail.
6. Accordingly, bail application is allowed. It is directed that the Applicant - Saarim Hussain @ Saalim Hussain, who has been accused in FIR No.417 of 2025, under Sections 121 (1), 132, 190, 191 (2), 191 (3), 221, 324(3), 351 (2), 352, 109, 196 (1) (c) of BNS read with Section 7 of the Criminal Law Amendment Act and Section 3 of the Prevention of Damage to Public Property Act, at Police Station Kashipur, District Udham Singh Nagar, be released on bail on furnishing a personal bond with two sureties each in the like amount to the satisfaction of the concerned court. The Applicant shall cooperate with the trial proceedings and shall not misuse the liberty granted to him.
