NAINITAL, India, May 11 -- Uttarakhand High Court issued the following judgment/order on April 9:
1. Heard learned counsel for the parties.
2. The main prayer made in the writ petition is for issuing appropriate direction to the respondentdevelopment authority to execute the demolition order dated 23.08.2024 (Annexure No.1) passed against respondent no.4.
3. In the compliance affidavit filed by respondent no.2 the stand taken is that an appeal is pending against the sealing order dated 12.04.2024. It is further stated that a revision at the behest of the development authority in relation to the demolition proceedings initiated by it is pending before the Joint Chief Administrator, Uttarakhand Awas Evam Nagar Vikas Pradhikaran, Dehradun and after the said proceedings are decided further action would be taken accordingly.
4. Learned counsel for the petitioner submits that the demolition order was set aside in appeal. Against the said order, the development authority has preferred a revision, which is pending. He submits that appropriate direction be issued to the Joint Chief Administrator, Uttarakhand Awas Evam Nagar Vikas Pradhikaran, Dehradun to expedite the proceedings of the revision.
5. Having regard to the facts of the case and the submissions made, the writ petition is disposed of by providing the revision, if still pending, shall be decided by the authority concerned expeditiously.
6. Needless to state that further action in the matter shall be taken by the development authority based on the outcome of the revision and the appeal which are pending.
7. Pending application, if any, also stands disposed of.
