NAINITAL, India, April 17 -- Uttarakhand High Court issued the following judgment/order on March 17:
1. Mr. Piyush Shrivastav, learned counsel for the Applicant.
2. Mr. G.C. Joshi, learned AGA with Mr. J.P. Kandpal, learned Brief Holder, for the State of Uttarakhand.
3. In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant - Sanjay Pal, who has been accused in Case Crime No.374 of 2024, under Sections 65 (1) of the Bharatiya Nyaya Sanhita, 2023 and under Sections 5 (j) (ii)/6 of the Protection of Children from Sexual Offences Act, 2012, at Police Station Haldwani, District Nainital.
4. Learned counsel for the Applicant submits that the FSL report regarding the DNA sequencing, the report is ambiguous and itself forms the ground for bail in favour of the Applicant.
5. Considering the overall facts and circumstances of the case, the Applicant has made out a case for bail. 6. Accordingly, bail application is allowed. It is directed that the Applicant - Sanjay Pal, who has been accused in Case Crime No.374 of 2024, under Sections 65 (1) of the Bharatiya Nyaya Sanhita, 2023 and under Sections 5 (j)
(ii)/6 of the Protection of Children from Sexual Offences Act, 2012, at Police Station Haldwani, District Nainital, be released on bail on furnishing a personal bond with two reliable sureties each in the like amount to the satisfaction of the concerned court. The Applicant shall cooperate with the trial proceedings and shall not misuse the liberty granted to him.
