NAINITAL, India, March 26 -- Uttarakhand High Court issued the following judgment/order on Feb. 25:

1. Mrs. Neelima Mishra, learned legal aid counsel for the Appellant.

2. Mr. J.P. Kandpal, learned Brief Holder, for the State of Uttarakhand.

3. The present matter is listed today for final hearing. 4. Appellant was convicted for the offence punishable under Sections 376, 363 and 366-A of IPC, and under Sections 3/4 of the POCSO Act, vide judgment and order dated 28.11.2017, passed by the court of learned Sessions Judge, Pauri Garhwal in Special Session Trial No.04 of 2017, "State Versus Mukarram Ali". Challenging his conviction and sentence, Appellant has filed this appeal.

5. Learned legal aid counsel for the Appellant further submits that the period so stipulated in the order of the conviction has been dealt with, and matter may be decided accordingly.

6. Learned State Counsel submits referring to the custody report submits that the Appellant has undergone the period of punishment as awarded to him and has been released.

7. Custody report is being submitted in the Court today and the same is made part of the record.

8. Since nothing survives in the criminal appeal, the present criminal appeal stands disposed of accordingly.

9. File may be consigned to the record room.
