UTTARAKHAND HIGH COURT ISSUES JUDGEMENT ON AAKASH V/S STATE OF UTTARAKHAND

NAINITAL, India, April 17 -- Uttarakhand High Court issued the following judgment/order on March 17:

1. Mr. Subhash Chand Burman, learned counsel for the Applicant.

2. Mr. S.S. Chauhan, learned DAG with Mr. Vikash Uniyal, learned Brief Holder, for the State of Uttarakhand.

3. In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant - Aakash, who has been accused in FIR No.237 of 2025, under Sections 109 (1), 3 (5) of the Bharatiya Nyaya Sanhita and under Section 3/25 of the Arms Act, at Police Station Kankhal, District Haridwar.

4. Learned counsel for the Applicant submits that the Applicant has falsely been implicated in the present matter and he is languishing in jail since 19.11.2025.

5. Learned State Counsel submits that the Applicant is a habitual offender having 01 more criminal case of similar nature.

6. Considering the overall facts and circumstances of the case, the Applicant has not made out a case for bail.

7. Consequently, the bail application is dismissed.
