AGARTALA, India, Feb. 10 -- Tripura High Court issued the following order/judgement on Jan. 9:
This application has been filed by the applicant under Section 11(6) of the Arbitration and Conciliation Act, 1996 seeking appointment of an arbitrator to adjudicate the disputes between the parties arising out of the Memorandum of Understanding dt. 07.01.2009 in Arb.P.14 of 2025, Memorandum of Understanding dt. 07.01.2009 in Arb.P.15 of 2025 and Memorandum of Understanding dt. 30.07.2010 in Arb.P.16 of 2025.
Counsel appearing for the respondents states that he has no objection for appointment of an arbitrator to decide the dispute between the parties arising out of the work orders issued under said Memorandums of Understanding.
In view of the said submission, Justice G. Raghuram, Former Judge of the Andhra Pradesh High Court is appointed as an arbitrator to decide the disputes between the parties arising out of the work orders issued under said Memorandums of Understanding subject to the usual terms and conditions.
Learned Arbitrator is requested to take into consideration the Schedule of Model Fee prescribed under Schedule IV and the timeline prescribed under Section 29-A of the Arbitration and Conciliation Act, 1996 as amended.
Registry is directed to communicate the instant order along with a copy of the entire pleadings of the instant application to the learned Arbitrator forthwith.
The instant petition is disposed of.
Pending application(s), if any, shall also stand disposed of.
