AGARTALA, India, May 16 -- Tripura High Court issued the following order/judgement on April 13:
Heard Learned Senior Counsel, Mr. Purusuttam Roy Barman assisted by Learned Counsel, Mr. Samarjit Bhattacharjee appearing on behalf of the petitioner-accused. Also heard Learned P.P., Mr. Raju Datta appearing on behalf of the respondent-State.
The present petitioner, by filing this petition under Section 528 of BNSS, 2023 has challenged the Bishramganj PS case No.2023 BRG 029, Manubazar PS case No.2023 MNB 34 and Killa PS case No.2023 KLA 027.
At the outset, Learned P.P. appearing on behalf of the respondent-State submitted that since the subject matter of all the FIRs are different. So, the petitioner ought to have filed separate petitions for quashing the separate FIRs. Furthermore, according to Learned P.P., in two of the above cases, charge-sheets have been submitted and charges have already been framed against the petitioner-accused. So, according to Learned P.P., the present petition is not maintainable.
In reply to the submission made by Learned P.P. for the respondent-State, Learned Senior Counsel drawn the attention of this Court referring one judgment of the Hon'ble Supreme Court of India in Arnab Ranjan Goswami vs. Union Of India & Ors. reported in (2020) 14 SCC 12 and submitted that against the same subject matter, there cannot be multiple FIRs. So, Learned Senior Counsel urged before this court to admit the present petition.
However, since today is the first day. Let, the Staterespondents submit their reply. Thereafter, this Court shall hear both the sides regarding the question of maintainability of the present petition.
