AGARTALA, India, May 11 -- Tripura High Court issued the following order/judgement on April 9:

This petition under Section 482 of Cr.P.C is filed for issuing necessary direction upon the Learned Trial Court to dispose of the case on the ground that the case was filed in the year 2017 and till today the case could not be disposed of.

At the time of hearing, Learned Counsel for the petitioner-complainant has drawn the attention of the Court referring several orders of the Learned Trial Court and submitted that those orders were not passed in accordance with law. So, a direction may be given to the Learned Trial Court for early disposal of the case.

Learned P.P., Mr. Raju Datta appears on behalf of the State and submitted that every Court has got his own Case Diary and it is the prerogative of the Court to fix the matter in accordance with law and to dispose of the case. So, there is very least scope to pass any direction. Considered.

This is a case under NI Act and now pending before the Learned J.M. 1st Class, Court No.5, Agartala, West Tripura. From the orders annexed with the petition, it appears that the orders were passed very carelessly by the Learned Trial Court. Since the complainant is the victim of the case, so, it is quite natural that there may be a reasonable expectation that the Learned Trial Court would dispose of the case in accordance with law at an earliest possible convenience without being biased or without being favour to any person.

However, since the matter is pending long back and the case is of the year 2017, so, Learned Trial Court be asked to dispose of the case giving top priority within a period of 6(six) months from today after affording reasonable opportunity to both the sides to adduce their evidence and counter evidence.

With this observation, this present case stands disposed of.

Registrar(Judl.) be asked to obtain one report in the administrative side from the concerned Court within a period of 7(seven) days and to place the same before the undersigned.

Send a copy of this order to the Learned Trial Court immediately.
