AGARTALA, India, Feb. 9 -- Tripura High Court issued the following order/judgement on Jan. 8:

This application is filed seeking condonation of delay of 148 days in filing the writ appeal challenging the judgment of the learned single judge.

In the application for condonation of delay it is stated that the judgment impugned in the appeal was delivered on 02.08.2024; that the applicant received the certified copy of the judgment on 21.09.2024; that the applicant did not understand that by the judgment dated 02.08.2024 only notional fixation of the salary and allowances after promotion had been directed and only after the actual promotion order was served on him on 27.11.2024 this became obvious and thereafter this appeal came to be filed on 06.02.2025, after consulting the counsel and the counsel thought over the matter and then prepared the grounds of appeal.

This stand of the applicant has been opposed by the respondents who contended that no sufficient cause has been shown for not preferring the appeal within the period of limitation.

Having regard to the circumstances, it cannot be said that the delay on the part of the applicant is such as to result in the dismissal of this application.

In this view of the matter, subject to the applicant paying costs of Rs.1,000/- to the High Court Legal Services Committee, the delay of 148 days in filing this appeal is condoned.

The said payment shall be made within four weeks from today List the appeal [WA No.09/2025] for admission on 10.02.2026.
