AGARTALA, India, June 5 -- Tripura High Court issued the following order/judgement on May 4:
Learned Counsel, Ms. Saswati Nag is present on behalf of the applicant.
From the note of the Registry it appears that notice upon the respondent has been duly served but none appeared today when the matter is taken up.
This interlocutory application is filed for condoning the delay of 156 days in preferring the connected revision petition by which the applicant has challenged the judgment and order dated 06.06.2025 passed by Learned Judge, Family Court, Udaipur, Gomati Tripura in Cr. Misc 16 of 2024.
It is submitted by Learned Counsel for the applicant that the judgment and order passed by Learned Trial Court was an ex-parte order and by this time, the respondent has filed petition for execution. Learned Counsel for the applicant submitted that if the said judgment and order is not stayed by this Court then the applicant would be seriously prejudiced.
From the note of the Registry it appears that notice has been delivered on 13.04.2026.
Learned Counsel further submitted that the applicant is an auto driver and there is no one to look after his family. It was further submitted that there was a communication gap between the applicant and his Counsel as a result of which no effective steps could be taken on time.
In view of the submissions made by Learned Counsel for the applicant, the delay has been condoned.
It is noted that by order dated 06.06.2025, only Rs.3000/- has been awarded as maintenance by the Learned Trial Court. However, since the respondent did not appear to contest the present application inspite of receipt of notice, so, there remains no impediment in considering the prayer for condonation of delay.
Accordingly, the delay of 156 days in preferring the connected revision petition is hereby condoned.
The interlocutory application stands allowed and disposed of.
