AGARTALA, India, March 4 -- Tripura High Court issued the following order/judgement on Feb. 2:
[1] Heard Mr. P. Roy Barman, learned Sr. Counsel assisted by Mr. Kawsik Nath, learned Counsel, appearing for the petitioner.
[2] Also heard Mr. A. Chakraborty, learned Counsel appearing for the respondent Nos.5 & 6.
[3] Mr. P. Gautam, learned senior GA has appeared for the respondent Nos.1, 2 & 3.
[4] The petitioner is a widow-daughter of late Birendra Chandra Karmakar who was working under the Directorate of Secondary Education and he died-in-harness on 03.01.2000 while working as a Headmaster-in-charge, Taltala H.S. School, Bamutia. After his death, his wife, namely, Lalita Karmakar would get the family pension who also died her natural death on 19.03.2022 [Part of Annexure-1]. Thereafter, the petitioner applied for family pension vide her application dated 27.06.2023 [Annexure-3] along with all required documents. As no response was received by the petitioner, she also sent one Advocate notice dated 26.08.2025 and in turn, from the office of the Accountant General, it was informed to her by letter dated 08.09.2025 [Annexure-12] that already a letter was issued to the Headmaster, Taltala H.S. School on 07.08.2025 with a request to furnish a copy of Form-3 as was furnished by the original pensioner while in service or during the period of his retirement with reference to para 2(V) of Finance Government, Government of Tripura memorandum dated 12.04.2010 for settlement of the claim of the petitioner but reply of the said letter was still awaited.
[5] Mr. Roy Barman, learned senior counsel during hearing submits that recently they have received a letter sent by the Head of Office of Taltala H.S. School to the Senior Accounts Officer, Office of the Accountant General, Tripura dated 21.01.2025 informing that the necessary documents like DDO certificate, acceptance of Head of Department, Recent Income certificate, Non-Re-Marriage certificate etc. of the petitioner have been forwarded to them. It was further informed that no Form-3 was furnished by the original government employee, Birendra Karmakar while he was in service. The Head of Office thereby requested the Senior Accounts Officer to consider the case. The petitioner has also placed the said letter in the record by an affidavit.
[6] Ld. Counsel, Mr. A. Chakraborty, on behalf of the Accountant General submits that the office of Accountant General has not taken any final decision on the issue and matter is pending and if a short time is granted to them, they will finalize the matter.
