AGARTALA, India, March 4 -- Tripura High Court issued the following order/judgement on Feb. 2:
Heard learned counsel appearing for the parties.
This is an application filed under Section 151 CPC for a direction to release the maturity value of the Fixed Deposit Certificate lying in the name of the applicant-petitioner which was deposited in the name of the petitioner when he was minor.
Learned counsel for the applicant has submitted that the award was passed on 19.02.2014 when the applicant was minor and by the passage of time, the applicant has attained the age of majority, and thus, there is no bar to release the deposited amount in favour of the applicant. Learned counsel has also submitted that the fixed deposit certificate is in the name of the Registrar General.
Learned counsel for the respondent has not raised any objection.
Accordingly, the applicant is permitted to withdraw the amount. Registry is directed to do the needful in this regard.
In view of the same, this application is allowed and thus disposed of.
