GANGTOK, India, April 1 -- Sikkim High Court issued the following judgment/order on March 2:
On the last date, vide Order dated 19-03-2026, the Counsel for the Appellant had submitted that the matter was settled between the contesting parties before the Learned Motor Accidents Claims Tribunal, in MACT Execution Case No.13 of 2025 (Sarita Gupta vs. The Branch Manager, National Insurance Company Limited, Gangtok and Another). The Learned Counsel for the Appellant had sought time to file necessary documents.
Now, I.A. No.02 of 2026 has been filed for withdrawal of the instant Appeal (MAC App No.19 of 2025) along with Deed of Compromise dated 16-03-2026, executed between the Respondent No.1 and the Appellant and Respondent No.2.
None is present for the Respondent No.1 today, however in view of the Deed of Compromise, the Appellant is allowed to withdraw the Appeal.
Appeal stands withdrawn accordingly and disposed of.
Pending applications, if any, also stand disposed of.
