GANGTOK, India, Aug. 29 -- Sikkim High Court issued the following judgment/order on Aug. 13:
Petitioners are present in person.
Learned Counsel for Petitioners, as required vide Order of this Court dated 12-08-2025, has filed an Affidavit on the same date duly furnishing copies of the Order Sheets of the Court of the Learned Chief Judicial Magistrate, District Gyalshing, Sikkim, in GR Case No.11 of 2024.
It is submitted by Learned Counsel for the Petitioners that the instant Petition is rendered infructuous for the reason that the matter was compounded before the Court of the Learned Chief Judicial Magistrate. That, Sections 417, 419 and 420 of the Indian Penal Code, 1860 (hereinafter, the "IPC"), were the offences under which the Petitioner No.2 was booked. That, the offences under Sections 417 and 419 of the IPC being compoundable and Section 420 of the IPC being compoundable with the permission of the Court were accordingly compounded. That, the Order of the Learned Chief Judicial Magistrate, dated 17-07-2025, reflects the same. In the circumstances, the Petitioners be allowed to withdraw the Petition.
Learned Additional Public Prosecutor submits that he has no objection to the prayer put forth in view of the compounding of the offences and the consequent acquittal of the Petitioner No.2.
Considered submissions, perused the Orders of the Learned Chief Judicial Magistrate, District Gyalshing. In view of the Order dated 17-07- 2025, the Petition stands disposed of as infructuous.
Pending applications, if any, also stand disposed of.
