PATNA, India, Feb. 10 -- Patna High Court issued the following order on Jan. 9:

1. The present interlocutory application, under Section 5 of the Limitation Act, 1963 has been filed for condoning the delay which has taken place in filing the present appeal.

2. The learned counsel for the appellant submits that the appellant and his family is very poor, hence it had taken some time for the father of the appellant to pool in his resources for the purposes of filing the present appeal, hence a meager delay of 49 days has taken place, thus it is submitted that a sympathetic view be taken and the delay of 49 days which has taken place in filing the present appeal, be condoned.

3. The learned APP for the State has not opposed the prayer of the appellant for condonation of delay in filing the appeal.

4. We have perused the present petition and considered the submissions made by the appellant and find that sufficient cause has been shown to condone the delay in filing the present appeal.

5. Accordingly, I.A. No. 1 of 2025 is allowed and delay of 49 days, which has taken place in filing the appeal, is condoned.
