PATNA, India, June 11 -- Patna High Court issued the following order on May 13:

Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in connection with Panapur P.S. Case No. 213 of 2024 instituted for the offences punishable under Sections 115, 118(1), 117, 109, 103(1) and 3(5) of B.N.S.S.

3. As per the prosecution case, the allegation against the accused persons including the petitioner is that they assaulted the informant and her husband brutally by means of deadly weapons due to which the informant's husband sustained injury and died in course of treatment.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case only on the basis of land dispute attributed between the parties. He submits that petitioner has not committed any offence as alleged in the FIR. He further submits that there is no specific allegation against the petitioner to assault the deceased with Bamboo and iron rod on stomach and pith (back). He next submits that charge sheet has already been submitted against the petitioner in this case, so there is no any question for absconding or tampering with the evidence, if the petitioner released on bail. Petitioner has got no criminal antecedent as stated in para 3 of the petition is in custody since 26.10.2024.

5. Learned APP opposes the prayer for bail.

From perusal of the case diary, FIR, postmortem report and the impugned order of the learned 11th Additional Sessions Judge, Saran at Chapra dated 30.01.2025, it appears that petitioner is named in the FIR. From perusal of the records, it appears that on the basis of written report of the informant Anita Devi, FIR has been lodged under Sections 115, 118(1), 117, 109, 103(1) and 3(5) of B.N.S.S. against eight accused persons including the present petitioner. There is land dispute attributed between the parties. From the postmortem report, it reveals that the injury caused by hard and blunt substance. Similarly situated co-accused namely Raj Kishore Raut @ Raj Kishore Prasad and Brij Kishore Raut have been granted bail by a co-ordinate Benches of this Court in Cr. Misc. Nos. 19559 of 2025 and 16849 of 2025 vide orders dated 09.05.2025 and 19.03.2025, respectively, so considering all aspects of the matter, I am inclined to grant bail to the petitioner.

7. Accordingly the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-XI, Saran at Chapra in connection with Panapur P.S. Case No. 213 of 2024.
