PATNA, India, June 11 -- Patna High Court issued the following order on May 13:

Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in connection with Panchanpur P.S. Case No. 132 of 2024 registered for the offence under Sections 64 and 89 of the Bhartiya Nyaya Sanhita.

3. According to the case of prosecution, at the relevant time, the victim girl was aged about 19 years. On 20.10.2024, she filed a written complaint, alleging therein that from the last five years, the present applicant is continuously establishing physical relation with her on the pretext of marriage, due to which she became pregnant. It is further alleged that on 11.09.2024 also both of them fled away from there houses and subsequently on 16.09.2024, the present applicant left the company of the victim girl and fled away. On the basis of information given by the victim girl, offence has been registered.

Learned counsel for the petitioner would submit that the petitioner is innocent and has been falsely implicated in this case due to previous dispute with the father and family members of the victim girl. The medical report of the victim girl also does not support the case of prosecution. According to the counsel, the F.I.R. has been lodged by the victim girl after so many years of the incident. The petitioner is in custody since 21.10.2024 and chargesheet has already been filed and there is no likelihood of conclusion of trial in near future. On these grounds, it is prayed that the petitioner may be granted benefit of bail.

5. Learned A.P.P. for the State as well as learned counsel for the informant/victim girl opposed the arguments of the learned counsel for the petitioner.

6. Considering the submission put-forth by the learned counsel for the petitioner and without commenting upon the merit of the case, I am of the view that it is a case where the applicant should be granted the benefit of bail.

Accordingly, this application is allowed. Let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Panchanpur P.S. Case No. 132 of 2024.
