PATNA, India, June 11 -- Patna High Court issued the following order on May 13:
Heard learned counsel for the petitioner and learned counsel for the State.
2. This is the first regular bail application of the petitioner seeking his regular bail in connection with Sasaram Rail P.S. Case No. 140 of 2024 registered for the offence under Section 143(5) of BNS and Section 79 of the J.J. Act
3. According to the case of prosecution, on 19.02.2024, on the basis of the information received from the informant, officers of railway during checking found the two minor boys Aashish Kumar and Vikram, allegedly they were taken by the present applicant for doing the labour work without taking consent from their parents.
4. It is submitted by the learned counsel for the petitioner that petitioner is innocent and has falsely been implicated in the present case. Both the children were taken by him with the consent of their parents for doing some work. He further submits that other co-accused namely Sudama Kumar has already been granted regular bail by this Court. Petitioner is in custody since 20.12.2024, having no criminal antecedent. Therefore, on these grounds, it is prayed that the petitioner may be granted benefit of bail.
5. Learned counsel for the State opposes the arguments raised by the counsel for the petitioner.

8. Considering the submissions made by the counsel for the petitioner and further considering the detention period of the petitioner and considering the fact that co-accused has already been granted regular bail by this Court, I am of the view that it is a case where the petitioner should be granted benefit of bail.
9. Accordingly, the application is allowed.
10. The petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Rail, Gaya in connection with Sasaram Rail P.S. Case No. 140 of 2024.
