PATNA, India, April 23 -- Patna High Court issued the following order on March 23:
1. Heard learned counsel for the parties.
2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 309(6) of Bharatiya Nyaya Sanhita, 2023.
3. As per prosecution case, four unknown miscreants forcibly administered sedative to the brother of informant and looted the truck and left him on the roadside in an unconscious state.
4. It is submitted on behalf of the petitioner that this petitioner is innocent and has falsely been implicated in this case. Petitioner's name has come in this case during course of investigation on the basis of confessional statement of coaccused. Only allegation against the petitioner is that his car was parked near the house of said co-accused. No incriminating article has been recovered from the conscious possession of the petitioner. Petitioner claim clean antecedent.
5. Learned counsel for the State opposes the prayer for pre-arrest bail.
6. Considering the aforesaid facts of the case, prayer for bail of this petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let this petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate II, Patna City in Gaurichak Police Station Case No. 663/2025, subject to the conditions laid down under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
