PATNA, India, May 29 -- Patna High Court issued the following order on May 1:

Heard Mr. Rajesh Ranjan, learned counsel appearing on behalf of the petitioner and Mr. Bindhyachal Singh, learned senior counsel appearing on behalf of O.P. No.2.

2. Both parties are appearing in person.

3. The modes of payment amicably decided between the parties, where the first installment of Rs.25,00,000/- (Rupees Twenty-five lakhs) shall be paid by O.P. No.2, namely, Raghvendra Dubey positively by 30th of May, 2025 by way of demand draft drawn/RTGS in favour of petitioner Mr. Nitish Sharma. It is further agreed between the parties that beside aforesaid amount, by the end of this year Rs. 75,00,000/- (Rupees Seventy-five Lakhs) shall be paid to petitioner, Nitish Sharma by O.P. No.2 for which three postdated cheques in favour of petitioner i.e. dated 30th June 2025, 30th October 2025 and 30th December 2025 shall hand over to the petitioner on next date of hearing.

Besides above, it is also agreed between the parties that rest of Rs.2,33,00,000/-(Rupees Two Crores Thrirty-three Lakhs) shall be paid in further four installments for which the four different post-dated cheques will be also hand over to the petitioner on next date of hearing by O.P. No.2, i.e. cheque for first installment of Rs. 50,00,000/- (Rupees Fifty Lakhs) dated 30th June 2026, second cheque of Rs. 50,00,000/- (Rupees Fifty Lakhs) shall be dated 30th December 2026, third cheque of Rs. 50,00,000/- (Rupees Fifty Lakhs) shall be dated 30th June 2027 and final/fourth cheque for the balance amount of Rs.83 Lakh (Eighty-three Lakhs), shall be dated 15th March 2028.

5. In view of mutual settlement as discussed above, O.P. No.2 is directed to hand over aforesaid seven post-dated cheques total of Rs.3,08,00,000/-(Three crore Eight Lakhs) to the petitioner on next date of hearing.

6. At the request of Mr. Bindhyachal Singh, learned senior counsel appearing for O.P. No.2, re-notify both these matters on 08.05.2025, position be retained.

7. Both parties are directed to remain present in person on next date of hearing.

8. In the meantime, interim order dated 28.03.2025 qua petitioner shall remain continued.
