PATNA, India, Sept. 1 -- Patna High Court issued the following order on Aug. 1:

Heard Mr. Uday Chand Prasad, learned counsel for the petitioner and Mrs. Renu Kumari, learned Additional Public Prosecutor for the State.

2. Petitioner seeks bail who is in custody since 29.12.2023 in connection with Shri Nagar P.S. Case No. 91 of 2022, F.I.R. dated 06.08.2022 for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.

3. According to prosecution case, this petitioner along with other accused persons have murdered the sister and niece of the informant.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. He further submits that the allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not committed any offences as alleged in the F.I.R. From perusal of the F.I.R it appears that the F.I.R instituted on the basis of suspicion and informant is not the eye witness of the alleged occurrence. He further submits that the co-accused persons have been granted regular bail by this Court and the case of the petitioner is on the similar footings.

Learned Additional Public Prosecutor on the basis of material available on record as well as case diary has vehemently opposed the prayer for bail of the petitioner and submits that it has come during investigation that the petitioner was involved in the present crime in question. The confessional statement of the co-accused, namely, Md. Jibrail was recorded who happens to be the husband of the deceased and he has categorically stated that the petitioner was also involved in the present occurrence and the present case is the case of double murder.

6. Considering the aforesaid facts and circumstances, I am not inclined to enlarge the petitioner on bail in connection with Shri Nagar P.S. Case No. 99 of 2022 pending in the court of learned Additional Sessions Judge I, Madhepura.

7. Prayer is refused.
