PATNA, India, June 11 -- Patna High Court issued the following order on May 13:
Heard the learned Advocate for the petitioner and the learned APP for the State.
2. The petitioner apprehends his arrest in connection with Katra P.S. Case No. 112 of 2024, registered for the offences punishable under Sections 341, 323, 379, 448, 324, 325, 307, 354, 504 and 506/34 of the Indian Penal Code.
3. Allegedly, while the informant was alone in her home, in the meanwhile, all the FIR named accused persons entered in her house and started misbehaving with her. When the son of the informant came there, allegedly the petitioner assaulted him by means of knife over his head, due to which he sustained serious injury. It is further alleged that co-accused Md. Furkan assaulted him by means of lathi and further Md. Abu Jaffar committed theft of golden chain.

Learned Advocate for the petitioner contended that both the parties are next door neighbours and in fact on the date of occurrence, on account of trifle, both the parties entered into a scuffle resulting into some injuries. The present case is nothing but a counter blast to Katra P.S. Case No. 111 of 2024 lodged by the father of the petitioner. The injury report falsifies the prosecution case, inasmuch as, no sharp cutting and incise injury found over the head of the son of the informant; rather one lacerated wound 1" X 1" over frontal head has been found. However, the same is caused by hard and blunt substance and the nature of which is said to be simple.
5. On the other hand, learned counsel for the State opposed the pre-arrest bail application and submits that the petitioner has assaulted the son of the informant over his head by means of knife. However, he is fortunate enough that he survived.

Regard being had to the submissions made on behalf of the parties and considering the factum of case and counter case, coupled with the injury report and the fact that the petitioner bears fair antecedent, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Muzaffarpur East in connection with Katra P.S. Case No. 112 of 2024, subject to the conditions laid down in Section 482(2) Bharatiya Nagarik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close family members of the petitioner.
