PATNA, India, June 18 -- Patna High Court issued the following order on May 18:

1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has prayed for bail in connection with N.H. Bangra P.S. Case No.07 of 2023 registered for the offence punishable under Section 392 of the Indian Penal Code.

3. The case of the prosecution, in short, is that, three unknown miscreants on a bike intercepted the informant in the way and on point of gun, robbed the bike of the informant bearing registration no. BR331P 2306.

4. Learned counsel appearing on behalf of the petitioner has submitted that the FIR was lodged against unknown miscreants. During course of investigation one of the co-accused Sudhanshu Kumar was apprehended and he has given his confessional statement. The name of this petitioner has surfaced in the confessional statement of Sudhanshu Kumar. Save and expect the confessional statement, there is nothing against the petitioner. No recovery has been made from the possession of the petitioner. The petitioner is in judicial custody since 06.02.2024.

5. The application for bail is opposed by learned APP for the State. He has submitted that the petitioner is having criminal antecedent of 12 cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail with the condition that the petitioner shall cooperate in the trial; shall appear in the learned trial court, whenever required and shall mark his weekly attendance at Tajpur P.S.

7. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the court of learned J.M.F.C., Samastipur in connection with N.H. Bangra P.S. Case No.07 of 2023.
