PATNA, India, June 10 -- Patna High Court issued the following order on May 12:
Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner apprehends his arrest in connection with Complaint Case No. 339 of 2021, wherein cognizance has been taken for the offence punishable under Section 420 of the Indian Penal Code.
3. Allegedly, on account of fake agreement, the petitioner realised an amount of Rs.18 lacs from the complainant on different dates. However, when the petitioner refused to execute the sale deed and when the complainant asked to return his money, the petitioner furnished two cheques, which came to be dishonoured; hence, the present complaint.
4. Learned counsel for the complainant submitted with all vehemence that the money of the complainant has been misappropriated and has not been returned. Two criminal cases are also pending against the petitioner.
5. Learned counsel for the petitioner, at this juncture submitted that there is a chance of settlement between the parties, if the matter be sent to the Patna High Court Mediation & Conciliation Centre.
6. Considering the nature of allegation and the submissions advanced by the learned counsel for the respective parties, let the matter be referred to the Patna High Court Mediation & Conciliation Centre. The parties are directed to appear before the Mediation Centre on 16.05.2025 along with the order of this Court and the relevant documents.
7. Upon appearance of the parties, the learned Mediator shall take all endeavours to settle the dispute amicably.
8. Re-notify this case after eight weeks' along with the report of the learned Mediator.
9. In the meantime, interim protection as granted by this Court to the petitioner vide order dated 28.03.2025 shall remain continued.
