PATNA, India, Sept. 1 -- Patna High Court issued the following order on Aug. 1:
Heard learned counsel for the petitioner and learned APP for the State.
2. This is the second attempt on behalf of the petitioner for grant of bail in connection with Gopalganj (Town) P.S. Case No. 510 of 2023 registered for the offence punishable under Section 411 of the Indian Penal Code and Section 8(c) and 21(b) of the N.D.P.S. Act.
3. Earlier the bail application of the petitioner has been rejected vide order dated 21.06.2024 passed in Cr. Misc. No. 27532 of 2024.
4. As per the prosecution case, 7.6 grams of Smack like substance has been recovered from the possession of the petitioner. The petitioner is in custody since 01.07.2023.
5. In the trial charge has been framed.
6. Considering the aforesaid fact and the period of custody, this application is allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. 1st Gopalgan/ concerned Court in connection with Gopalganj (Town) P.S. Case No. 510 of 2023, subject to the condition that both the bailors should be the blood relative of the petitioner.

As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed in the trial. Noncompliance of the condition will result in cancellation of the bail bonds of the petitioner.
9. The petitioner will also mark attendance in Thawe Police Station, District-Gopalganj on every Sunday of the month. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioner.
