PATNA, India, July 2 -- Patna High Court issued the following order on June 2:

Heard Learned Counsel for the petitioner and Learned APP for the State.

2. The present criminal miscellaneous application has been filed under Sections 483 and 484 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of regular bail to the petitioner who is in custody in connection with Naubatpur P.S. Case No. 39 of 2025, lodged on 15.01.2025, under Section 310(2) of the Bhartiya Nyay Sanhita, 2023.

3. As per the prosecution, FIR has been lodged against six unknown accused persons against whom there is allegation that they have committed dacoity and took away the articles from the premises of the informant.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that the petitioner is not named in the FIR. Counsel submits that the petitioner is in custody since 24.01.2025 having clean antecedent. Counsel further submits that during investigation his name has figured in this case due to the reason that on his statement recovery of tractor, which was subject to dacoity, has been made. Counsel further submits that in the impugned order it has come that the petitioner is the second purchaser of the said tractor. Counsel further submits that actually from the version of the prosecution itself, the petitioner is not involved in the dacoity rather he is the second purchaser of the said tractor and he submits that he is basically the victim. He further submits that at worst his involvement is only up to that extent that he has illegally purchased the said tractor.

5. Learned APP for the State opposes the prayer for bail of the petitioner and fairly submits that ingredient of dacoity is not against the petitioner but it is on record that he is the second purchaser of the tractor.

6. In the present facts and circumstances of this case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of A.C.J.M.-VI, Danapur, Patna, in connection with Naubatpur P.S. Case No. 39 of 2025, subject to the conditions as laid down U/s 480(3) of the BNSS, 2023.
