PATNA, India, July 2 -- Patna High Court issued the following order on June 2:
Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks regular bail in connection with Udwantnaga (Gajrajganj O.P.), P.S. Case No. 125 of 2025, lodged on 11.03.2025, under Section 317(5) of the BNS, 2023 and under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
3. As per the prosecution, FIR has been lodged against two persons, including the present petitioner. The petitioner was found in possession of 120 litres of illicit desi liquor on a motorcycle and was apprehended by the police.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. It is further submitted that the petitioner has been in custody since 12.03.2025, having clean criminal antecedent. Counsel also submits that the motorcycle in question does not belong to the petitioner and he has been falsely implicated in the present case. It is further submitted that such a mistake shall not occur in the future and the petitioner is ready to comply with any condition that may be imposed by this Hon'ble Court.
5. Learned APP for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted regular bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) as mentioned in Section 2(1) (d) of the BNSS, 2023 to the satisfaction of Exclusive Special Judge, Excise, Court No. 2, Bhojpur at Ara, in connection with Udwantnaga (Gajrajganj O.P.), P.S. Case No. 125 of 2025, subject to the following conditions as laid down under Section 480(3) of the BNSS.
