PATNA, India, June 11 -- Patna High Court issued the following order on May 13:

Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in connection with Darpa P.S. Case No. 215 of 2024 registered for the offence under Sections 191(2), 190, 126(2), 115(2), 118(1), 109, 303(2), 308(3), 308(4), 111(3), 352, and 351(2) of the Bhartiya Nyaya Sanhita.

According to the case of prosecution, on 29.12.2024 at about 7:40 P.M., police Inspector of Chauradano P.S. reached the house of the informant for inquiry of certain cases and after his return, it is alleged that the present applicant along with other accused persons assaulted Ved Prakash Kumar and Lal Saheb Rai due to which they sustained injuries. It is further alleged that they also demanded money from the informant as ransom. It is further alleged that one of the accused persons also looted Rs. 25,000/- from the pocket of Mukesh Kumar. On the basis of information received from the informant, Pawan Prasad, F.I.R. has been registered. During investigation, present applicant has been arrested on 30.12.2024.

4. Learned counsel for the petitioner would submit that the petitioner is innocent and has falsely been implicated in this case. Virtually, one of the accused persons family lodged a case against the informant and others and therefore, this case is the counter blast of said F.I.R. He further submits that Ved Prakash has sustained only simple injury. Lastly, it is submitted by the counsel that the petitioner is in custody since 30.12.2024 and charge-sheet has already been filed and there is no likelihood of conclusion of trial in near future. On these grounds, it is prayed that the petitioner may be granted benefit of bail.

5. Learned A.P.P. for the State opposed the prayer for bail of the petitioner.

6. Considering the submission put-forth by the learned counsel for the petitioner, I am of the view that it is a case where the applicant should be granted the benefit of bail. Accordingly, this application is allowed. Let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Darpa P.S. Case No. 215 of 2024.
