PATNA, India, July 2 -- Patna High Court issued the following order on June 2:
Learned Counsel for the petitioner and Learned APP for the State are present.
2. The present criminal miscellaneous application has been filed under Sections 483 and 484 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of regular bail to the petitioner who is in custody in connection with Barh P.S. Case No. 141 of 2025, lodged on 22.02.2025, under Sections 137(2), & 87 of the B.N.S., 2023.
3. As per the prosecution, FIR has been lodged against the petitioner with the allegation that he has kidnapped the minor daughter of the informant.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel
also submits that the victim went with the petitioner with her consent and they entered into the marriage. He further submits that there are two criminal antecedents of the petitioner for kidnapping of the same girl. He further submits that otherwise petitioner's antecedent is clean and he is in custody since 24.02.2025.
5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that admittedly the petitioner has performed marriage with the minor girl with her consent has but has no value in the eyes of law.
6. In the present facts and circumstances of this case, this Court is not inclined to enlarge the petitioner on bail in connection with Barh P.S. Case No. 141 of 2025 pending in the court of learned Additional Chief Judicial Magistrate-I, Barh, Patna.
7. Accordingly, the prayer for bail of the petitioner is hereby rejected.
