PATNA, India, July 2 -- Patna High Court issued the following order on June 2:

Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks regular bail in connection with Complaint Case No. 490C/2022 arising out of NTPC P.S. Case No. 6/2021 under Section 304B of the Indian Penal Code.

3. The accusation is of killing the daughter of the complainant for non-fulfillment of dowry demand.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. He further submits that the petitioner has clean antecedents and has been in custody since 21.12.2024. The petitioner, aged about 64 years, is the father-in-law of the deceased and has been falsely implicated in this case. It is submitted that initially, NTPC P.S.

Case No. 06 of 2021 was registered, and upon completion of investigation, a final form was submitted on 27.10.2021. However, on a protest petition filed by the complainant, the Court took cognizance under Section 304B of the Indian Penal Code. The petitioner undertakes to comply with all conditions that may be imposed by this Hon'ble Court.

5. Learned counsel for the State opposes the prayer for bail and submits that although a final form was initially submitted, the Court has taken cognizance on the basis of a protest-cum-complaint petition.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) as mentioned in Section 2(1) (d) of the BNSS, 2023 to the satisfaction of learned Judicial Magistrate 1st Class, Barh Patna, in connection with Complaint Case No. 490C of 2022, arising out of NTPC P.S. Case No. 06/2021, subject to the conditions as laid down under Section 480(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
