PATNA, India, June 11 -- Patna High Court issued the following order on May 13:

Heard learned counsel for the petitioners as well as the counsel appearing for the respondent-State.

2. It is the first regular bail application submitted by the petitioners who have been arrested in connection with Chapra Muffasil P.S. Case No. 654 of 2024 for the alleged offences punishable under Sections 103(1), 61(2), 3(5) of the Bharatiya Nyaya Sanhita.

3. In this case, the name of the deceased is Rounak Kumar, his dead body was found lying in the campus of the water park situated near Mehiyan four lane on 31.10.2024. The matter has been reported by the mother of the deceased wherein it is alleged that the murder of Rounak Kumar was committed by the named accused persons wherein name of the present applicants Amarnath Manjhi and Bhuar Manjhi are also mentioned. On the basis of said information FIR has been registered and during the course of investigation both the applicants were arrested on 03.11.2024 and since then they are in custody.

4. It is submitted by the counsel for the petitioner that the petitioners herein are innocent and are falsely implicated in this case. He submits that in this case there is no any eye-witness, the informant has mentioned the name of the present applicants only on the basis of suspicion. Nothing incriminating was found from the possession of the present applicants which was used in the murder of the victim Rounak Kumar. He further submits that in this case another co-accused Amit Kumar Singh against whom similar allegation was there has also been granted benefit of bail by this Court. Therefore, it is prayed that on these grounds the present applicants who are in custody since 03.11.2024 may be granted the benefit of regular bail.

5. Learned counsel appearing on behalf of respondentState opposes the prayer of bail.

Considering the submission made by the counsels and particularly considering the fact that the co-accused Amit Kumar Singh has also been granted the benefit of bail by this Court, without further commenting on the other merits of the case, I am of the view that in this case the present applicants should be granted the benefit of bail. Accordingly, the petition is allowed. The petitioners are directed to be released on bail in connection with Chapra Muffasil P.S. Case No. 654 of 2024 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties, to the like amount each to the satisfaction of the learned C.J.M, Saran.
