PATNA, India, June 11 -- Patna High Court issued the following order on May 13:
Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in connection with Garkha P.S. Case No. 35 of 2025 registered for the offence under Sections 126(2), 115(2), 109, 74, 3(5) of the B.N.S.
3. According to the prosecution case, it is alleged that on 15.01.2025 at about 01:00 P.M, firstly the accused persons tried to outrage the modesty of the daughter of the informant and when the informant and her husband tried to intervene, allegedly, all the accused persons along with the present applicant assaulted all of them due to which they sustained injury on the body. The matter was reported and on the basis of which, offence has been registered.
4. Learned counsel for the petitioner would submit that the present applicant has falsely been implicated in this case due to some previous dispute. It is further submitted that a counter case is also lodged by the present applicant against the informant party. Lastly, it is submitted that the injuries sustained by the informant are of simple in nature. Therefore, prima facie no offence of attempt to murder is made out against the present applicant. He is in custody since 18.01.2025. The trial is not likely to be concluded in near future. On these grounds, the petitioner may be granted the benefit of bail.
5. Learned A.P.P. for the State opposed the prayer for bail of the petitioner.

Considering the submission put-forth by the learned counsel for the petitioner, particularly, considering the period of detention as well as nature of injuries sustained by the informant, I am of the view that it is a case where the applicant should be granted the benefit of regular bail. Accordingly, this petition is allowed. Let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saran at Chapra in connection with Garkha P.S. Case No. 35 of 2025.
