PATNA, India, July 2 -- Patna High Court issued the following judgment on June 27:
1. Heard Shri N.K.Agrawal, Learned Senior counsel for the petitioner and the Learned counsel for the respondents.
2. The Learned Senior counsel submitted that during pendency of the case before the Commission, the petitioner has paid 50% of the amount, and further, the Commission has directed payment of the balance amount of Rs. 4,31,807/-. The Learned Senior counsel only seeks permission, to pay the balance amount in three equal installments within a period of three months.
3. Taking into consideration that the petitioner is ready to pay the balance amount, the petition is directed to pay the balance amount in three equal installments commencing from 15th July, 2025. He shall pay the entire balance amount by 15th September, 2025. However, the certificate case and the FIR pertain solely to the recovery of the amount decided by the Commission headed by Hon'ble Justice Uday Sinha. Once the amount is paid, nothing remains to be recovered from the petitioner by way of the certificate case. Therefore, Misc. Case No. 16/2011-12 has to be closed by the respective authorities after the receipt of the amount and further the FIR (Asarganj P.S. Case No. 54 of 2011),
shall not be proceeded against the petitioner. The authority is directed to withdraw the said FIR from the concerned police station after receipt of the amount.
4. With the abovesaid observations, the writ petition shall stand disposed of.
