PATNA, India, Aug. 4 -- Patna High Court issued the following judgment on July 15:
Heard learned Counsel for the petitioner and learned Counsel for the Accountant General. Learned Counsel for the State is not present.
2. The present writ petition has been filed for issuance of appropriate writ in the nature of mandamus directing the respondents to grant him the benefits of A.C.P. and M.A.C.P. Further prayer is of consequential revision of his pension and other benefits to which petitioner is entitled under the Rules.
3. Learned Counsel for the petitioner relied on the judgment passed by this Hon'ble Court in CWJC No.11200 of 2024.
4. It transpires to this Court that petitioner has demanded writ of mandamus from the Court but representation is lacking in the present case. As such, this Court only dispose off the writ petition directing the petitioner to file the representation along with a copy of this order before respondent No.3, the Chief Engineer, Sinchai Srijan, Water Resources Department, Saharsa, within 30 days from today and respondent No.3, the Chief Engineer, Sinchai Srijan, Water Resources Department, Saharsa, is directed to pass a reasoned and speaking order on the representation of the petitioner within 90 days thereafter.
