PATNA, India, July 30 -- Patna High Court issued the following judgment on July 14:

Heard Learned Counsel for the petitioner and Learned Counsel for the State.

2. Learned Counsel for the petitioner submits that the present writ petition has been filed with the following reliefs:-

(I)That the relief/reliefs that are being prayed for in this writ petition are for issuance of a writ in the nature of writ of certiorari to quash/ set aside the order dated 14.01.2025 passed by the Ld. D.P.O. (I.C.D.S), Sasaram (Rohtas) whereby and where under in Appeal Case No. 09/2024, the respondent D.P.O. has set aside the selection of the petitioner as Anganwari Sevika pursuant to a general body meeting dated- 17.04.2018 by which the petitioner had been selected as Anganwari Sevika for Gosaldih Panchayat, Village- Jamuara, Ward No. 14 and also for a direction to the Ld. District Magistrate to dispose of the appeal filed by the petitioner and for a further prayer to restore the appointment of the petitioner as Anganwari Sevika for said Ward/Village and/or for issuance of any other writ/writs, order/orders, direction/directions to grant relief/reliefs to which the petitioner may be found entitled to in the fact and circumstances of the case.

3. Counsel for the State raised preliminary objection and submits that the alternative remedy is already available for the petitioner to challenge the order passed by D.P.O. before the Collector by way of filing an appeal.

4. Counsel for the petitioner submits that the appeal has already filed before the Collector which he has annexed vide annexure-P/2, but number of appeal is available in the record.

5. In the light of the submissions made, the present writ petition is hereby disposed off directing the petitioner to file his representation before the Collector, Sasaram, Rohtas (respondent No.1). If there is already number given in appeal by the Collector Office, then the Collector Office shall pass order within 90 days from the date of appearance of all concerned, otherwise, the Collector Office shall allot a fresh number in his appeal and pass order within the said period.

6.With the aforesaid directions and observations, the present writ application stands disposed off.
