PATNA, India, July 18 -- Patna High Court issued the following judgment on July 10:

1.The writ petition is filed to quash the Memo No. 402 and order dated 18.02.2016 passed by the Sub-Divisional Officer-cum-Licensing Authority, Biraul, Darbhanga whereunder the petitioner's PDS License No. 20 of 2001 was cancelled.

2.Being aggrieved by the said order, the petitioner preferred an appeal i.e. Appeal No. 45 of 2016, before the District Magistrate, Darbhanga. The appellate authority confirmed the order of cancellation of the PDS license and dismissed the appeal on 19.07.2017. Aggrieved by the orders of the appellate authority, the petitioner also preferred a revision before the Divisional Commissioner, Darbhanga. It is the petitioner's case that the said revision was pending. It is noticed that the petitioner has not challenged the orders of the appellate authority i.e. order passed by the District Magistrate, Darbhanga.

3.During the course of argument, the Counsel for the petitioner submitted that a direction may be given to the Divisional Commissioner to dispose of the revision, Revision No. 3 of 2018, filed by the petitioner which is still pending before the Divisional Commissioner, Darbhanga.

4.A detailed counter affidavit was filed on 10.12.2018 by the respondents. The counter affidavit also reveals that the revision is pending.

5.Heard the Learned counsel for the petitioner as well as the Learned counsel for the respondents.

6.There is no information from either the petitioner or the department as to whether the revision is still pending or not? If the revision is still pending, the revisional authority, i.e., the Divisional Commissioner, shall dispose of the revision within one month from the date of receipt of this order.

7.With the abovesaid observation, the writ petition shall stand disposed of.
