PATNA, India, Oct. 6 -- Patna High Court issued the following judgment on Sept. 8:

Heard learned counsel for the parties.

2. The petitioner has filed the instant application for the following relief(s) :-

"1. That the instant writ petition is being filed for issuance of Mandamus calling for the connected records pertaining to the selection of Lady Supervisor from the post of Aanganwari Sevika for the district of Jamui and on being satisfied be pleased to set aside the selection of private respondent no.-8 in general category or in alternative to direct the Divisional Commissioner, who is empowered under Clause-ix of the Government Resolution contained in Resolution no.-1846 dated 10.06.2010 to conduct the enquiry and dispose of the application/complaint filed by the petitioner after giving personal hearing to the concerned parties or be pleased to pass any order or orders which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case for doing complete justice in the matter."

3. The petitioner moved the Collector, Jamui with respect to selection of Lady Supervisor from the post of Anganwadi Sevika for the District of Jamui for which Advertisement no.1 of 2024 was published in the daily newspaper.

Learned counsel for the petitioner submits that an application having been filed on the above subject by the petitioner before the District Magistrate-cum-Chairman of the District Level Selection Committee, Jamui, after hearing on the petition of the petitioner for two days, the petitioner by communication dated 2.7.2025 (Annexure-P/9) was given liberty to move the Divisional Commissioner as per the relevant provision in resolution dated 10.6.2010. The petitioner has moved the same, however the same remains pending.

5. Learned counsel for the respondents submits that the writ application is not maintainable for the reason that the petitioner has no locus to move against the process of appointment as is being attempted to be done by the petitioner herein.

Without going into the merits of the case of the parties, it is directed that the Divisional Commissioner, Munger Division, District-Munger (respondent no.2) will decide the application/petition of the petitioner (Annexure-P/10 series) in accordance with law within the period stipulated in the resolution dated 10.6.2010.

7. It is made clear that the Court has not gone into the locus of the petitioner in challenging the process or filing of the petition before the Divisional Commissioner which will be open for the respondents to raise and the same will also be decided by the Divisional Commissioner.

8. The writ application stands disposed of.
