PATNA, India, Sept. 3 -- Patna High Court issued the following judgment on Aug. 4:

Heard learned counsel for the petitioner and learned counsel for the State.

2. The present writ petition has been filed with the following reliefs:-

"(i) For issuance of an appropriate writ, order or direction directing and commanding the respondents to appoint the petitioner on the post of Sanitation Supervisor in Singhara Panchayat, Block Maner, District-Patna as he was selected on the post of Swachhagrahi vide no.997 dated 24.8.2021 and he has also completed training conducted by the concerning authority.

(ii) For issuance of any other appropriate writ, order or direction as Your Lordships may deem fit and proper."

3. Learned counsel for the petitioner submits that the matter is relating to appointment of Sanitation Supervisor under the Lohiya Shwachhta Mission. Counsel submits that copy of the Lohiya Shwachhta Mission, which has been issued by the Chief Executive Officer-cum- Mission Director to all District Magistrate-cum-Chairman, District Water and Sanitation Committee, Bihar (Annexure-P/7), in which the competent authority relating to appointment is the D.D.C.-cum- Vice Chairman of the Committee. Counsel submits that representation has been filed before the D.D.C.cum-Vice President vide Annexure-8 on 16.08.2024, but till date no decision has been taken. Copy of the same has also been communicated to the District Magistrate-cum-Chairman, District Water and Sanitation Committee, Bihar.

4. Learned Counsel for the State submits that respondent No.2, the D.D.C. -cum- Vice Chairman, Water and Sanitation Committee, Patna, may be directed to take a decision on the representation filed by the petitioner (Annexure-P/8).

In the light of the submissions made, particularly when a representation has already been filed in the form of complaint before respondent No.2, the D.D.C.-cumVice Chairman, Water and Sanitation Committee, Patna, the respondent No.2, the D.D.C.-cum- Vice Chairman, Water and Sanitation Committee, Patna, shall take decision on the representation of the petitioner in accordance with law after hearing respondent No.7 within 90 days from the date of receipt/production of a copy of this order before him. The date of 90 days shall be counted upon completion of appearance of respondent No.7.
