PATNA, India, Nov. 24 -- Patna High Court issued the following judgment on Nov. 1:
Heard the parties.
2. The petitioner claims to be Secretary of UMS Gobindbara Kanya School Blcok-Phenhara, East Champaran has approached this Court for the following reliefs:
"i. For issuance of appropriate order/s, especially in nature of certiorari that quashed Letter No2447 dated 28.06.2025 passed by the District Education Officer, East Champrana, Motihari whereby and where under The Education Officer, East Champaran, Motihari, under the PM Shri Yojana, transfer the students of UMS Gobindbara Kanya School Blcok-Phenhara to Haji Farzand High School Phenhara, which is not accordance with law because students of class 6 to 8 of UMS Gobind Bara Kanya School already start their study and continue their education peacefully.
ii. For issuance of appropriate order/s, direction/s to the respondents concern that continue the education of students in UMS Gobindbara Kanya School, Phenhara, where students of class VI to VIII already admit under PM Shri Yojana and continue their education peacefully. iii. For issuance of appropriate direction/s to the respondent concern that disposal the representation which is submit before him for consideration the grievances of petitioner which is pending before him since month July 2025. iv. During the pendency of writ application/operation of the Letter No- 2447 dated 28.06.2025 passed by the District Education Officer, East Champaran, Motihari kindly be stay. V. For issuance of appropriate rule/s or direction/s of this Hon'ble Court may found fit and proper to the facts and circumstances of the case as well as for which the petitioner may be found entitle thereto."

Learned Advocate for the petitioner submitted that besides the fact the academic environment and the education of the students of Class-6 to 8 of UMS Gobind Bara Kanya School are being hampered, the action of the respondent authorities are wholly illegal and contrary to all the norms, rules and regulations. The petitioner, being the Secretary of the School in question, representing the parents of the students has preferred representation before the District Magistrate, East Champaran, Motihari but no action has been taken till date, compelling her to approach this Court by invoking the jurisdiction under Article 226 of Constitution of India.
4. Learned Advocate for the State while refuting the contention of the petitioner, has submitted that despite the fact the petitioner has no locus standi, the matter is already pending before the District Magistrate, who shall look into the matter and take a final decision.
5. Having considered the submissions advanced and the nature of the grievance as also the fact that the petitioner has already made a detailed representation, which is pending consideration before the District Magistrate, East Champaran, Motihari, the present writ petition is disposed of with hope and expectation that the respondent no. 3 shall look into the matter and consider the representation of the petitioner, copy of which is placed on record as Annexure-3, and pass appropriate order keeping in mind the interest of the students of the School.
6. The writ petition stands disposed.
