PATNA, India, Aug. 4 -- Patna High Court issued the following judgment on July 15:

In the instant petition, petitioners have prayed for the following relief:-

That this is an application for issuance of the appropriate writ/writs/direction/order/orders commanding the respondents to make payment of Rs. 3,05,28,000/- as compensation amount with statutory interest in favour of petitioners in lieu of acquisition of his lands bearing Khata No. 159, Khesra No. 838 Area 90 decimal situated in mauza-Bankat, Thana No. 194 Anchal-Motihari, District- West Champaran,which land of the petitioner has been acquired by the state-respondents for construction and establishment of Mahatma Gandhi Central University, Motihari, East Champaran though Land Acquisition (LA) Case No. 06/13-14 Award No. 89.

Learned counsel for the petitioners submits that petitioners' land bearing khata no. 159, khesra no. 838, area 90 decimal situated in mauza-Bankat, Thana No. 194, AnchalMotihari, District- West Champaran has been acquired for establishment of Mahatma Gandhi Central University, Motihari. Learned counsel submits that an amount Rs. 3,05,28,000/- (Three crore five lakh twenty eight thousand) has been paid through RTGS but the said amount has been paid to fake persons as is evident from Annexure- P/3 and the Land acquisition officer, East Champaran has filed a criminal case for the same. It is submitted that an amount of Rs. 1,31,13,200/- ( One crore thirty one lakh thirteen thousand two hundred) has been recovered but petitioners, who are entitled to get the recovered amount, has not been given the amount. It is submitted that Shukhdev Sah, the father of the petitioners, has already died and petitioners being the sons of Shukhdev Shah are entitled to get the recovered amount. Learned counsel has submitted that after death of father of the petitioners, petitioners have not represented before any competent authority for the compensation amount.

3. Learned counsel on behalf of the State has submitted that petitioners have not represented their grievance before any competent authority. If petitioners represent their grievance before competent authority, the same shall be looked into.

Considering the facts and circumstances of the case and submission advanced on behalf of the parties, the writ petition stands disposed of with liberty to the petitioners to represent their grievance by filing representation before the competent authority within four weeks from the date of receipt of the order. If such representation if filed within the stipulated period, the concerned authority shall hear the grievance of the petitioners and pass appropriate order, as per provision of law, without being prejudiced by the order passed by this Court.
