PATNA, India, July 30 -- Patna High Court issued the following judgment on July 14:
Heard learned Counsel for the petitioner, learned Counsel for the Bihar Technical Service Commission and learned Counsel for the State.
2. The present writ petition has been filed with the following reliefs:-
"I. To issue appropriate writ(s), order(s) direction(s) in the nature of mandamus to the respondent authorities especially to the Respondent No. 3, directing therein to rectify the mistake committed in totalling the marks obtained by the petitioner in the Bihar A.N.M. Exam held on 12.01.2024 vide Advertisement no. 07/2022.
II. Further, a writ of Mandamus be issued to the respondent no. 1 directing and commanding therein to include the petitioner in the selected list of candidates for the post of A.N.M. in furtherance of Advertisement no. 07/2022, on the basis of revised marks of the petitioner as obtained in the above-said exam held on 12.01.2024 by declaring the result of the petitioner.
III. Further, direction be issued to the respondent no. 1, Department of Health, Bihar to appoint the petitioner on the post of A.N.M. accordingly in view of the order dated 14.05.2025 as passed in S.L.P. No. 12696/2024.
IV. Any other relief(s) be granted to the petitioner, for which he is entitled to in accordance with law."
3. Learned Counsel for the petitioner submits that as per the determination, more marks has to come but she has been given lower marks. Therefore, she wants retotalling of her marks.
4. Learned Counsel for the Bihar Technical Service Commission submits that there is no provision of law for retotalling or re-checking of the answer sheet. The entire process has been done by the T.C.S.
5. Learned Counsel for the State is present.
6. Upon the specific query of the Court that whether petitioner is ready to deposit Rs.50,000/- before the Commission so that Commission may recalculate the total marks on payment of fee to the T.C.S.
7. Learned Counsel for the petitioner submits that she is ready for depositing the same.
8. Let the petitioner be directed to pay Rs.50,000/- to the Commission and Commission shall direct the T.C.S. for retotalling of her marks and provide to the petitioner within 90 days from the date of receipt/production of a copy of this order along with the Demand Draft of Rs.50,000/- in favour of the Commission.
9. It is made clear that if petitioner's marks after retotalling comes above than the cutoff, then the Commission shall include the petitioner in the select list of candidates for the post of A.N.M. within 30 days thereafter.
10. With the aforesaid direction, the writ petition stands disposed off.
