PATNA, India, Oct. 15 -- Patna High Court issued the following judgment on Sept. 16:

In the instant LPA, the appellants have assailed the order of the learned Single Judge dated 13.02.2025 passed in CWJC No. 2436 of 2025.

The core issue involved in the present lis is construction of Panchayat Sarkar Bhawan in the appellants village, on the other hand official respondents have undertaken to construct the Panchayat Sarkar Bhawan in Aslempur village. It is contrary to the policy decision of the State Government. Therefore, the matter is required to be interferred insofar as construction and establishment of Panchayat Sarkar Bhawan at Tuturkhi. The appropriate venue for establishment of Panchayat Sarkar Bhawan in terms of the policy is Aslempur village.

3. We have noticed that establishment and construction of Panchayat Sarkar Bhawan is stated to have been undertaken in the year 2024 and it is stated that in June-2024 civil construction has commenced.

4. This has been disputed by the learned counsel for the appellants to that extent that it has commenced in the month of January-2025.

Be that as it may, the appellants have approached this Court by filing CWJC No. 2436 of 2025 on 11.02.2025, as on the date of filing of writ petition, civil work for construction of Panchayat Sarkar Bhawan has already commenced. Petitioners have not pressed for the status quo to be maintained insofar as establishment and construction of Panchayat Sarkar Bhawan at Tuturkhi.

6. At this juncture, it is not appropriate to interfere. Even though appellants have made out a prima facie case on merits. This Court is not inclined to demolish constructed building or under construction in respect of Panchayat Sarkar Bhawan at Tuturkhi. In the event of taking such step, would result in financial loss to the State exchequer and society, therefore, the appellants have not made out a case so as to interfere with the order of the learned Single Judge dated 13.02.2025 passed in CWJC No. 2436 of 2025.

7. LPA stands dismissed.

8. Pending I.A., if any, stands disposed of.
