PATNA, India, June 18 -- Patna High Court issued the following judgment on June 17:
Re: Interlocutory Application No. 03/2025. The aforenoted interlocutory application has been pressed for condoning the delay of 54 days in filing the present appeal.
2. For the reasons stated in the interlocutory application, the delay in filing the present appeal is condoned.
3. Interlocutory Application No. 03/2025 stands allowed.
LPA No. 329 of 2025 4. Heard Mr. Md. Helal Ahmad, the learned Advocate the appellant and Mr. Asif Kalim, the learned Advocate for the State.
5. By the impugned judgment, the Circle Officer, Azamnagar, Katihar has been directed to conclude the proceedings of Encroachment Case No. 01 of 2024-25, if the same was still pending.
6. The appellant apprehends that in view of such a direction by the learned Single Judge, and in the event of hearing of the aforenoted encroachment case being expedited, the appellant, who is alleged to be the encroacher, would not be heard by the Circle Officer.
7. This apprehension is absolutely misplaced. All that the impugned judgment directs is that the case be concluded at the earliest. This does not preclude the authority concerned from hearing the parties and passing a reasoned order, which can only happen if the parties to the dispute are heard.
8. We do not find any reason to interfere with the impugned judgment.
9. The appeal is meritless and is thus dismissed.
