Rai, J. Heard Learned Senior Counsel for the Applicants. Issue Notice to the Respondent.
Learned Public Prosecutor is present for the Respondent on advance Notice and waives formal Notice.
Heard on I.A. No.01 of 2025, which is an application filed by the Applicants under Section 5 of the Limitation Act, 1963, seeking condonation of 44 days' delay in filing the instant Appeal. Learned Senior Counsel submits that the delay occurred on account of the ill-health of the Counsel.
Learned Public Prosecutor submits that he has no objection to the I.A. supra as the grounds mentioned therein pertain to the ill-health of the Counsel.
We have heard the submissions and perused the Petition. We find that the delay has been sufficiently explained. Delay of 44 days' is accordingly condoned.
I.A. No.01 of 2025 stands disposed of. Register the Appeal.
