PATNA, India, July 9 -- Patna High Court issued the following judgment on July 3:

1. The petitioner has filed the instant application for the following reliefs:

"To direct the respondents as to make payment of Rs.67,709.00, in terms of the Letter No. 1730 dated 30.12.2015 and payment of Rs. 2,87,595.00, in terms Letter No. 1731 dated 30.12.2015, issued under the signature of the District Manager, Bihar Food State Corporation, Chapra, to the petitioner towards milling charge and handling charge of paddy and transportation of C.M.R. (Custom Milled Rice) to the godown.

(II) To direct the respondents as to make payment to the petitioner of the said amount together with simple interest @ 12%, as the said amount is due of the procurement year 2013-14 and 2014-15.

(III) For grant any other relief or reliefs which may deem fit and proper in the facts and circumstances of the case."

2. During the course of the arguments, the Learned counsel for the petitioner seeks indulgence of this Court to grant liberty to file the representation before the authority and direct the authority to pass necessary orders duly taking into account the representation filed by the petitioner.

3. Without going into merits of the case, the petitioner is directed to file a representation before the authority within four weeks from the date of receipt of this order. In turn, the appropriate authority shall consider the representation and pass an appropriate order within three months from the date of filing of the representation.

4. With the aforesaid observations, the Writ petition is disposed of.

5. Interlocutory Application(s), if any, shall stand disposed of.
