PATNA, India, Oct. 15 -- Patna High Court issued the following judgment on Sept. 16:
In the instant Writ petition, petitioner has prayed for the following relief(s):-
"i. For issuance of a writ in the nature of Certiorari for quashing the recommendation/decision recorded in the Minutes of the Meeting of the Technical Committee held on 12.08.2025 in respect of E-Tender (NIT No. 02/2025-26 dated 23.06.2025), whereby the petitioner was disqualified on the alleged ground of non-fulfilment of Clause 17(4) due to non- submission of the original affidavit, which action is wholly arbitrary, contrary to the principles of natural justice, illegal, and without jurisdiction.
ii. For issuance of a direction upon the Executive Officer, Respondent No. 3, to declare the petitioner as technically qualified in respect of the aforesaid NIT and consequently to open and consider the financial bid of the petitioner in accordance with law.
iii. For setting aside the financial bid table (Annexure-P/6).
iv. For restraining the respondents particularly Respondent No. 3 from cancelling the aforesaid E-Tender (NIT No. 02/2025-26 dated 23.06.2025) or publish any new or similar tender or re-tender
v. For directing Respondent No. 3 to cancel the award of contract or the purchase order, if any;
vi. For directing the Respondent No. 3 not to proceed further or issue any order in the Tender E-Tender (NIT No. 02/2025-26 dated 23.06.2025) till the final disposal of this writ.
