PATNA, India, July 1 -- Patna High Court issued the following judgment on June 27:

Heard the parties.

2. The present application came to be filed for initiating a contempt proceeding against the opposite parties for their wilful disobedience of the order/judgment of this Court dated 11.01.2023 passed in CWJC No. 9735 of 2021, whereby this Court while allowing the writ petition had directed the concerned respondents to ensure payment of all the admissible death-cum-retiral outstanding dues to the petitioner with effect from 03.03.2002, the date on which the erstwhile employee declared civil death along with the admissible statutory interest as payable under the law as early as possible, preferably within a period of 12 weeks from the date of receipt/production of a copy of this order

3. On the last occasion when the matter was taken up on 04.04.2025, this Court had directed the respective opposite parties to clarify the position with regard to the interest of family pension as well as gratuity in compliance with the order of this Court.

4. Learned Advocate for the petitioner fairly contended that so far the other admissible dues are concerned, the same have been paid to the petitioner, except the interest over the delayed payment of gratuity and family pension.

5. Second supplementary show cause affidavit has been filed and it has been apprised to this Court that 'no objection certificate' has already been issued by the Superintendent of Police, Katihar and sent to the Treasury Officer, Samastipur for ensuring compliance of the order of this Court. However, till date response of the Treasury Officer is awaited in the matter. It is the specific contention that any interest over the amount of gratuity and family pension is to be made by the Treasury Officer.

Considering the facts that there is substantial compliance of the order of this Court and the grievance of the petitioner is now only confined to interest over the delayed gratuity and family pension which is awaiting from the level of the Treasury Officer, this Court deems it fit and proper to dispose off the contempt petition with a hope and expectation that the treasury Officer, Samastipur in consultation with the Superintendent of Police, Katihar shall ensure payment of admissible interest over the gratuity and family pension, as directed by this Court.

7. The application stands disposed off.
