PATNA, India, July 23 -- Patna High Court issued the following judgment on July 11:
The present MJC is for restoration while recalling the order dated 26.02.2020 passed in MJC NO. 658 of 2020 arising out of LPA No. 721 of 2018.
2. We are astonished to know that the copy of the order dated 26.02.2020 passed in MJC No. 658 of 2020 which is to be recalled is not accompanying with the MJC petition.
3. Having regard to the fact that it has been part of the present MJC and it has been produced without there being any interlocutory application for production of document, however, in the interest of litigant we have taken note of the order dated 26.02.2020 and proceed to recall the same passed in MJC No. 658 of 2020 arising out of LPA No. 721 of 2018.
4. Accordingly, order dated 26.02.2020 passed in MJC No. 658 of 2020 arising out of LPA No. 721 of 2018 is recalled subject to payment of cost of Rs. 5000/-.
5. Cost shall be remitted in the Lawyers' Association Welfare Benevolent Fund, Indian Bank, Branch-LNMI, Bailey Road, Patna, IFSC No. IDIB000L501 having Bank Account No. 7801893276 within a period of eight weeks.
6. Registry is requested to restore the MJC No. 658 of 2020 on the file and list the matter before the concerned roster bench at the earliest.
7. MJC No. 785 of 2022 stands disposed of.
