PATNA, India, Aug. 21 -- Patna High Court issued the following judgment on July 22:
Ref: I.A. No. 01 of 2019 Heard I.A. No. 01 of 2019 for condonation of delay. There is a delay of about 14 days in filing L.P.A. No. 1489 of 2019. For the reasons stated in the application read with the affidavit, delay of about 14 days in filing L.P.A. No. 1489 of 2019 stands condoned.
2. Accordingly, I.A. No. 01 of 2019 stands allowed. 3. With the consent of the learned counsels for the respective parties, L.P.A. No. 1489 of 2019 is taken up for final disposal.
4. Having regard to the disputed issue relating to subject land and proposal for construction of Panchayat Sarkar Bhawan, the same cannot be adjudicated under Article 226 of the Constitution. Aggrieved person has a remedy before the Civil Court in filing Civil suit insofar as disputed issue is concerned, learned counsel for the Appellant submitted that even to this day they have not undertaken any construction of Panchayat Sarkar Bhawan at Tola Labhri of Kerap Panchayat at Khata No. 35, Plot No. 3522, Area 5 Bigha, 6 Kattha, 10 dhoor, which is alleged to be a private land of the petitioner and stated to have been recorded as Gair Majarua Malik. Hence, Appellant has not made out a ground to interfere with the order of the learned Single Judge. Accordingly, the present L.P.A. No. 1489 of 2019 stands dismissed, reserving liberty to invoke appropriate remedy before appropriate Forum.
