PATNA, India, Sept. 3 -- Patna High Court issued the following judgment on Aug. 4:

The petitioner, one of the aspirants to the post of Auxiliary Nurse Midwifery in connection with Advertisement no. 7 of 2022 is aggrieved with the result published by the Bihar Technical Service Commission vide Memo No. 1596 dated 28.05.20225, has approached this Court seeking quashing of the same and further to direct the respondents to appoint the petitioner, who is said to have been qualified the examination conducted by the Commission and obtained total 22.70 % marks, while candidates obtaining lesser marks have been selected.

The petitioner having completed two years course of Revised Auxiliary Nurse Midwifery submitted her application through Online on 26.08.2022 for the post of Auxiliary Nurse Midwifery (hereinafter referred to as 'the ANM') in terms of Advertisement No. 7 of 2022 for total number of 10709 posts, out of which 2403 posts were reserved for Extremely Backward Class Category candidates. The Commission on 03.03.2023, issued a direction under letter no. 612 requesting the candidates to verify the details and to correct the error, if any, after assigning reason within the period 07.03.2023 to 17.03.2023. In the light of the letter aforenoted, the petitioner corrected the error caused by Cyber Cafe in category of her caste, which was found to be Backward Class, though the petitioner falls under Extremely Backward Class Category. The petitioner was called upon in the counselling, held on 28.02.2024; the EBC certificate furnished by the petitioner was verified and the category under EBC mentioned by one of the authority, but surprisingly later on it was struck off by the another officers and the category of the petitioner has been mentioned as unreserved. Again on 19.05.2025, the Commission issued another letter, bearing no. 1533 requesting the candidates to verify the marks and the cause of ineligibility and to correct the error, if any, with reasons within a stipulated period. The petitioner again corrected the error caused by the Cyber Cafe in the category. Finally on 28.05.2025, the Commission published the merit list, in which out of 2403 posts reserved for EBC category, all those candidates of EBC category, who have applied i.e. only 1421 candidates were selected and yet 982 posts are lying vacant.
